Class Cancellation Policy

Drop-in reservations must be cancelled at least 24 hours before class start time to receive a credit refund to the payment method on file. Cancellations made inside this window or failure to attend without cancelling will result in forfeiture of the $35.00 payment with no credit or refund issued.


No Refunds

Drop-in class purchases are non-refundable once booked. In the event a class is cancelled by Society 3, the drop-in fee will be refunded or credited in full.


Incorporation of Agreement Documents

By purchasing a drop-in class, purchaser confirms they have read, understood, and executed the Society 3 Liability Waiver & Informed Consent and acknowledges the Society 3 Studio Policies and Privacy Notice (CCPA/CPRA). All terms are incorporated into this Purchase Agreement by reference and are fully binding. A valid Liability Waiver must be on file before any class participation regardless of purchase type.

1. Nature of Activity

I understand that participation in group fitness classes at Society 3 involves vigorous physical activity including but not limited to: high-intensity interval training (HIIT), strength and resistance training, functional movement, kettlebell training, and cardiovascular exercise using machines and bodyweight. I acknowledge that these activities carry inherent risks including, but not limited to, muscular injury, joint strain, cardiovascular stress, cardiac events, falls, and equipment-related injury. I further acknowledge that Society 3 maintains an automated external defibrillator (AED) on premises in compliance with California Health & Safety Code §104113, and that all Society 3 coaches and staff are certified in CPR and AED use. I voluntarily assume the risk of cardiac and other medical events inherent to vigorous physical exercise.

2. Medical Clearance & Health Disclosure

I represent that I am in adequate physical condition to participate in group fitness activities. I acknowledge that Society 3 coaches are not licensed medical professionals, and nothing communicated by them constitutes medical advice, diagnosis, or treatment. If I have any pre-existing medical conditions, injuries, cardiovascular issues, orthopedic limitations, or other health concerns, I agree to consult a licensed physician before participating. I accept full personal responsibility for any medical decisions related to my participation. I agree to disclose any injuries or limitations to my coach before each class begins.

I understand that coaches provide general group instruction to the class as a whole and that it is my sole responsibility to self-regulate intensity, weight selection, range of motion, and overall effort based on my own physical condition and limitations at all times. No verbal cue, encouragement, or instruction from a coach constitutes a guarantee of safety or a representation that any specific movement or load is appropriate for my individual condition. I assume full and sole responsibility for all movement decisions I make during class, regardless of any verbal instruction received.

2A. Recovery Suite - Additional Assumption of Risk & Contraindication Acknowledgment

I understand that The Complete and Black Cat memberships, and the Recovery Suite drop-in, include access to the Society 3 Recovery Suite, which involves recovery modalities including pneumatic compression therapy (Normatec) and contrast (heat and cold) therapy (HypericeX), in addition to coach-led stretching and foam rolling.

I acknowledge that these modalities carry inherent risks separate from group fitness classes, including but not limited to: circulatory complications, dislodgement of blood clots, bruising, skin irritation, thermal burns, cold-related injury, dizziness, changes in blood pressure, and aggravation of pre-existing conditions.

Contraindication Acknowledgment. I represent that, to the best of my knowledge, I do not have any of the following conditions, and I understand that if I do, I must consult a licensed physician and obtain clearance before using the Recovery Suite:

  • Deep vein thrombosis (DVT), blood clots, or a history of clotting disorders
  • Peripheral arterial disease or other significant circulatory conditions
  • Pregnancy
  • Cardiovascular or heart conditions, including uncontrolled high blood pressure
  • Neuropathy or impaired sensation (including diabetic neuropathy)
  • Raynaud's disease or cold hypersensitivity
  • Open wounds, skin infections, recent surgery, or acute injury in a treatment area
  • Any condition for which compression therapy or heat/cold therapy has been medically advised against

I understand that Society 3 staff are not licensed medical professionals and cannot assess my individual suitability for these modalities. I agree to disclose any relevant condition before using the Recovery Suite, to follow all staff instructions regarding equipment use, and to discontinue use immediately and notify staff if I experience pain, numbness, dizziness, or discomfort during any recovery session. I voluntarily and knowingly assume all risks associated with my use of the Recovery Suite and its equipment, to the fullest extent permitted by California law.

3. Assumption of Risk

I voluntarily and knowingly assume all risks associated with participation in Society 3 classes and activities - whether on or off the premises - including risks arising from the active or passive negligence of Society 3, HIIT IT LLC, its owners, coaches, employees, agents, or volunteers, to the fullest extent permitted by California law. I further acknowledge and assume the inherent risk of potential exposure to communicable illnesses, including airborne and contact-transmitted infections, in a shared indoor fitness environment. I understand that Society 3 implements reasonable hygiene protocols but cannot guarantee a disease-free environment.

4. Release & Waiver of Liability

In consideration of being permitted to participate, I, on behalf of myself, my heirs, executors, personal representatives, and assigns, hereby release, waive, and forever discharge HIIT IT LLC, Society 3, its owners, coaches, employees, agents, successors, and assigns from any and all claims, demands, losses, causes of action, or liability of any kind - whether known or unknown, anticipated or unanticipated - arising out of or related to my participation, including claims arising from negligence.

Notwithstanding the foregoing, this release does not apply to claims arising from gross negligence or willful misconduct, which cannot be waived as a matter of California law. The inclusion of this limitation reflects the parties' shared intent to create a release that is enforceable to the maximum extent permitted by law.

5. Waiver of California Civil Code §1542

I expressly waive and relinquish all rights and benefits under California Civil Code §1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release." I acknowledge that I may later discover facts different from or in addition to those currently known, and I accept this waiver with full knowledge of this possibility.

6. Indemnification

I agree to indemnify, defend, and hold harmless HIIT IT LLC and Society 3 from any and all loss, liability, damage, cost, or expense incurred as a result of my participation in any Society 3 activity, including claims brought by third parties arising directly from my own conduct, actions, or negligence during participation. This indemnification obligation does not extend to claims arising from Society 3's own independent negligence or misconduct.

7. Emergency Medical Authorization

In the event of a medical emergency arising from my participation, I authorize Society 3 staff to contact emergency medical services on my behalf. I acknowledge that I am responsible for any costs associated with emergency medical care.

8. Severability

If any provision of this waiver is found to be invalid or unenforceable under California law, the remaining provisions shall remain in full force and effect.

9. Acknowledgment

I have read this waiver and release in its entirety. I understand its contents and I am signing freely and voluntarily, without inducement. I acknowledge this is a binding legal document.

Studio Policies

Class Reservations & Cancellations

All classes must be reserved in advance through the Society 3 app or website. A reservation holds your spot - walk-ins are subject to availability and are not guaranteed.

Cancellation Windows by Membership Type:

  • Committed, Complete & Black Cat Members: May cancel up to 12 hours before class start time without penalty.
  • All Other Members (Core, Charged, Class Pack, Drop-In): Must cancel at least 24 hours before class start time to avoid penalty.

Grace Pass - Committed, Complete & Black Cat Members Only:

Members on the Committed, Complete, or Black Cat membership tier receive one (1) automatic grace pass per calendar month, which waives the fee on their first late cancellation or no-show that month. The grace pass applies automatically - no request or phone call is required. Grace passes reset on the 1st of each month and do not roll over. The second offense in a calendar month and any offense beyond are charged at the standard $22 rate regardless of membership tier.

Late Cancel & No-Show Fee:

Cancellations made outside the applicable window, or failure to attend without canceling, will result in:

  • Unlimited members (Committed, Complete, Black Cat): a $22 fee charged to the payment method on file.
  • Class-allocation members (Core, Charged): a $22 fee, and the reserved class is deducted from the monthly allocation.
  • Class Pack holders: forfeiture of the reserved session (no fee).
  • Single drop-in purchasers (TriMethod or Recovery Suite): forfeiture of the drop-in payment (no additional fee).
  • Recovery Suite sessions: a $22 fee, and the session is forfeited from the monthly allotment.

Member acknowledges that these fees are intended to represent a reasonable estimate of Society 3's actual damages from an unfilled spot, including instructor time, reserved capacity, and operational overhead, and are not intended as a penalty.

Consistent no-shows or late cancellations (3 or more in a single month) may result in temporary suspension of reservation privileges at Society 3's discretion.

Booking Windows & Waitlists:

Booking windows vary by membership tier:

  • Committed, Complete & Black Cat Members: May book up to 1 month (30 days) in advance for all classes.
  • All Other Members & Non-Members (Core, Charged, Class Pack, Drop-In): May book up to 2 weeks (14 days) in advance.
  • Recovery Suite Drop-Ins: May book up to 72 hours in advance only.

If a class is full, members may join the waitlist via the app. Society 3 does not automatically enroll or charge waitlisted members. When a spot opens, the next member on the waitlist is notified by text and has 30 minutes to claim the spot through the app. If the spot is not claimed within that window, it passes to the next member on the list. Because claiming a spot is an affirmative action taken by the member, there is no fee or penalty for a waitlist offer that is not claimed. Once a member claims a spot, the standard cancellation policy for their tier applies.


Arrival & Punctuality

All members are asked to arrive at least 15 minutes before class to allow time for check-in, warm-up, and equipment setup. This is especially important for first-time attendees.

If you arrive after class has started, you may be admitted only during a transition between rounds - not mid-round. This policy exists to protect the safety of all participants and maintain the integrity of the programming. Admission after start time is at the coach's discretion and is not guaranteed.

Society 3 is not responsible for missed class time due to late arrival. No refunds or session credits will be issued for late arrivals.


Phone Policy

We have a no-phone policy during class. Phones must be silenced and put away before class begins.

This policy exists for three reasons: focus, safety, and respect for your fellow members. Our programming is structured and moves quickly - distractions from phones can result in missed cues, improper form, and risk of injury. We want you fully present.

Members may use phones briefly before class starts or during designated breaks. Photography or filming of other members without their explicit consent is prohibited at all times.


Equipment & Space

  • Use all equipment only as directed by your coach. Improper or unsafe use may result in removal from class.
  • Return all equipment to its designated storage location after every class.
  • Do not remove equipment from the studio floor.
  • Members found to have damaged equipment through negligent or improper use may be assessed a damage fee not to exceed $500 per incident. This limitation applies to damage caused by ordinary negligence only. Society 3 reserves the right to seek full damages - without cap - for equipment damage caused by reckless conduct, intentional acts, or willful misconduct. Society 3 will provide written notice of the alleged damage within 5 business days of discovery, including photographic or written documentation. Members have 10 days from receipt of notice to respond in writing before any charge is applied to the payment method on file.

Hygiene & Studio Cleanliness

  • Sanitizer and towels are provided at the studio. Members are expected to wipe down all equipment and surfaces they use after class.
  • Wear appropriate, clean athletic shoes at all times on the studio floor. No bare feet during class.
  • Be mindful of fragrance - strong perfumes or colognes can be disruptive in a high-intensity shared environment.
  • Do not attend class if you are experiencing symptoms of illness (fever, active infection, vomiting, etc.). Society 3 reserves the right to ask any member exhibiting signs of illness to leave the premises.

Personal Belongings

Society 3 is not responsible for lost, stolen, or damaged personal belongings. Please store valuables securely. Leaving personal items unattended on the studio floor during class is at the member's own risk.


Guest Passes (Bring a Friend)

Members on an unlimited tier (Committed, Complete, or Black Cat) receive three (3) guest passes per calendar month, subject to the following terms:

  • TriMethod classes only. Guest passes may not be used for Sunday Recovery Suite sessions.
  • First-time guests only. Guest passes are valid exclusively for first-time visitors to Society 3. Individuals who have previously attended Society 3 in any capacity (as a guest, drop-in, class pack holder, or member) are not eligible for guest pass entry.
  • Waiver required. Every guest must create a Society 3 account and complete the Society 3 Liability Waiver & Informed Consent before participating. No guest may take class without a signed waiver on file.
  • Subject to availability. Guests count toward class capacity and may only be booked into classes with open spots. A guest late cancellation or no-show forfeits the pass used.
  • Monthly reset. Guest passes reset on the 1st of each calendar month and do not roll over. Unused passes expire.
  • No cash value. Guest passes are non-transferable between members, have no cash value, and may not be sold or exchanged.
  • Revocable. Society 3 reserves the right to modify or revoke guest pass privileges at any time, including for misuse. The hosting member is responsible for their guest's conduct while in the studio.

Video Surveillance

Society 3 operates video security cameras on the premises for the safety of members, staff, and property. Please note:

  • Security cameras record video for safety, security, and incident documentation purposes only.
  • Security footage is never used for marketing, social media, or promotional content of any kind.
  • Cameras are located in training and common areas only. There are no cameras in restrooms.
  • Security cameras do not record audio.
  • Footage is retained for a limited period, stored locally on studio equipment with restricted access, and is not sold or shared with third parties except as required by law or in connection with an incident investigation or insurance claim.

Minors

Participants must be 16 years or older to attend Society 3 classes. If a participant is under 18 years of age, a parent or legal guardian must sign all Society 3 Agreement Documents on the participant's behalf prior to participation. A minor's signature alone is not valid or binding under California law. Minors may not sign any Society 3 document on their own behalf.


Health & Safety

  • Inform your coach of any injuries, limitations, or health conditions before each class begins. Coaches can offer modifications but are not licensed medical professionals.
  • If you feel dizzy, nauseous, or experience pain during class, stop immediately and notify your coach.
  • Nothing communicated by Society 3 coaches constitutes medical advice, diagnosis, or treatment.
  • Society 3 maintains a first aid kit and an automated external defibrillator (AED) on premises at all times, in compliance with California Health & Safety Code §104113. All coaches and staff are certified in CPR and AED operation. In the event of any medical emergency, staff will contact 911 immediately and administer emergency response as trained.

Disability Accommodations - ADA & California Unruh Civil Rights Act (Civil Code §51)

Society 3 is committed to providing reasonable accommodations to members and prospective members with disabilities in accordance with the Americans with Disabilities Act and the California Unruh Civil Rights Act. Society 3 does not discriminate against any person on the basis of disability, physical condition, or any other characteristic protected under California law.

Members who require an accommodation to participate in classes - including but not limited to modified movement sequences, equipment positioning, extended setup time, or other adjustments - are encouraged to notify a coach or staff member before class begins, or to submit a written request to meow@society3studios.com. Society 3 will evaluate all accommodation requests promptly and engage in a good-faith interactive process with the requesting member. Reasonable accommodations will be provided at no additional charge. Society 3 reserves the right to determine what constitutes a reasonable accommodation within the context of its group fitness programming and studio layout.


Member Conduct

  • Treat coaches, staff, and all members with respect at all times.
  • Harassment, discrimination, bullying, or intimidation of any kind will not be tolerated.
  • Society 3 reserves the right to refuse service or terminate any membership - immediately and without refund - for conduct harmful to the community, staff, or brand. The severity of the response will be proportionate to the incident.
  • Members removed for conduct violations forfeit any remaining prepaid sessions or membership term.

Agreement

By participating in Society 3 classes or maintaining an active membership, you agree to abide by all policies set forth in this document. These Studio Policies are part of the Agreement Documents and are incorporated into your Membership Agreement by reference.

Policy Updates: Society 3 reserves the right to modify these Studio Policies at any time. Members will be notified of any material change via the Society 3 app and/or the email address on file at least 14 days before the change takes effect. Continued use of Society 3 services on or after the effective date of any update constitutes the member's acceptance of the revised terms. If a member objects to a material policy change, they must notify Society 3 in writing within 14 days of receiving notice. Because membership cancellation is always effective immediately, a member who objects to a policy change may simply cancel at any time, and Society 3 will waive that billing cycle's payment if the cancellation is submitted within the 14-day objection window. Society 3 will maintain a version history of all material policy updates, available to members upon written request.

This Privacy Notice is provided to members and visitors of Society 3 in compliance with the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), California Civil Code §1798.100 et seq. Society 3 is committed to transparency about how we collect, use, and protect your personal information.


1. Categories of Personal Information We Collect

Society 3 collects the following categories of personal information from members and prospective members:

  • Identifiers: Name, email address, phone number, date of birth, emergency contact information.
  • Financial Information: Payment method details (credit/debit card) processed and stored securely through our payment processor.
  • Health & Physical Information: Self-reported medical history, injuries, and physical limitations disclosed on intake forms or verbally to coaches. (See Section 1A - Sensitive Personal Information below.)
  • Commercial Information: Membership type, class attendance history, class pack purchases, and retail transactions.
  • Visual Information (Marketing): Photographs and video recordings intentionally created by Society 3 staff for marketing purposes, only where consent has been provided via the optional Photo & Video Release.
  • Visual Information (Security): Video footage from on-premises security cameras, collected for the safety and security of members, staff, and property. Security footage is used exclusively for security and incident documentation, is never used for marketing or promotional purposes, is not sold or shared with third parties except as required by law or in connection with an incident investigation or insurance claim, and is retained for a limited period on locally stored, access-restricted studio equipment. Security cameras do not record audio.
  • Internet or Network Activity: Information collected through the Society 3 membership and booking platform, which is operated by Society 3 itself, including account login activity and app usage.

1A. Sensitive Personal Information (CPRA §1798.121)

Under the California Privacy Rights Act (CPRA), certain categories of personal information are classified as Sensitive Personal Information (Sensitive PI) and are subject to additional protections and disclosure requirements.

Society 3 collects the following Sensitive PI from members:

  • Health and Medical Information: Self-reported injuries, physical limitations, pre-existing conditions, and other health disclosures provided on intake forms or verbally to coaches prior to participation.

Purpose of Collection: This Sensitive PI is collected solely to ensure member safety, enable coaches to provide appropriate modifications, and maintain records in the event of a medical emergency or insurance claim.

Third-Party Sharing of Sensitive PI: Member health disclosures are stored within Society 3's own membership platform, which Society 3 builds and operates directly. This information is not transmitted to or stored by any third-party studio management provider. It is not shared with our payment processor, our email or messaging providers, or any advertising or analytics platform. Access is restricted to authorized Society 3 staff who require it to provide safe instruction or to respond to a medical emergency. Health disclosures are stored in encrypted form.

Your Right to Limit Use: Under CPRA §1798.121, you have the right to direct Society 3 to limit the use and disclosure of your Sensitive PI to only what is necessary to provide the fitness services you have requested. To exercise this right, submit a written request to meow@society3studios.com. Society 3 will not retaliate against any member for exercising this right.

Society 3 does not use Sensitive PI to infer characteristics about members beyond what is necessary to provide fitness instruction and ensure member safety.


2. Purposes for Which We Collect Personal Information

We collect personal information for the following business purposes:

  • To process membership enrollment, billing, and renewals.
  • To manage class scheduling, reservations, and attendance.
  • To ensure member safety by documenting health disclosures and emergency contacts.
  • To communicate with members regarding class schedules, policy updates, promotions, and account information.
  • To market Society 3's services through social media and other platforms, where consent has been given.
  • To maintain the safety and security of the studio premises through video surveillance.
  • To comply with applicable legal obligations.

We do not sell your personal information to third parties.


3. Third Parties With Whom We Share Personal Information

Society 3 shares member personal information only with the following categories of service providers, solely to the extent necessary to operate our business:

  • Payment Processor (Stripe, Inc.) - Handles membership billing, class pack and drop-in purchases, and fee transactions. Payment card information is transmitted directly to Stripe, which is PCI-DSS compliant. Society 3 does not store full payment card numbers on its own systems. Stripe acts as a service provider and is subject to its own privacy policy.
  • Communications Providers - Email and SMS service providers used to send account confirmations, class reminders, and waitlist notifications. These providers receive only the contact information necessary to deliver the message.
  • Insurance Provider - Limited information may be shared in connection with insurance claims or coverage verification.

Society 3's membership and booking platform is built and operated by Society 3 itself. There is no third-party studio management provider with access to member records.

We do not share your personal information with advertisers, data brokers, or any third party for the purpose of targeted advertising.


4. Retention of Personal Information

Society 3 retains member personal information for the duration of an active membership and for a period of three (3) years following membership termination or the last transaction, unless a longer retention period is required by law. Health disclosures and signed waivers may be retained for up to five (5) years for liability purposes.


5. Your Rights Under California Law (CCPA/CPRA)

As a California resident, you have the following rights with respect to your personal information:

Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the purposes for which it was collected, and the categories of third parties with whom it was shared.

Right to Delete: You may request that we delete personal information we have collected from you, subject to certain exceptions (e.g., information necessary to complete a transaction, comply with a legal obligation, or maintain a record for safety purposes).

Right to Correct: You may request that we correct inaccurate personal information we maintain about you.

Right to Limit Use of Sensitive PI: You have the right to direct Society 3 to limit the use and disclosure of your Sensitive Personal Information (health disclosures) to only what is necessary to provide our services. See Section 1A for details.

Right to Opt Out of Sale or Sharing: Society 3 does not sell or share personal information for cross-context behavioral advertising. No opt-out is required, but you may contact us at any time to confirm this.

Right to Non-Discrimination: We will not discriminate against you for exercising any of your rights under California law. Exercising your privacy rights will not affect your membership status, pricing, or access to services.


6. How to Exercise Your Rights

We will respond to verified requests within 45 days. If additional time is needed, we will notify you and may extend the response period by an additional 45 days.

To protect your privacy, we may ask you to verify your identity before processing your request.


7. Website Tracking Technologies & Global Privacy Control (CPRA §1798.135)

Society 3's website may use third-party tracking technologies, including analytics tools (such as Google Analytics) and advertising or social media pixels (such as Meta/Facebook Pixel, TikTok Pixel, or similar). Categories of data collected via website tracking: Device identifiers, IP address, browser type, pages visited, time spent on pages, referral source, and behavioral interaction data.

Purpose: Website analytics, advertising performance measurement, and remarketing to prospective members.

Third parties receiving this data: Google LLC (Google Analytics), Meta Platforms Inc. (Facebook/Instagram Pixel), TikTok Inc. (TikTok Pixel), and other advertising platforms as applicable. Each of these parties operates under its own privacy policy and data processing terms.

Global Privacy Control (GPC): In accordance with CPRA §1798.135 and California Privacy Protection Agency (CPPA) regulations, Society 3 honors Global Privacy Control (GPC) browser signals as a valid opt-out of the sale or sharing of personal information for cross-context behavioral advertising. If your browser has GPC enabled, Society 3 will treat this as an automatic opt-out request and will suppress applicable tracking for your session. To enable GPC, visit globalprivacycontrol.org for compatible browsers and extensions.

Opt-Out: To opt out of the sale or sharing of your personal information via website tracking technologies independent of GPC, contact us at meow@society3studios.com or submit a request via the method described in Section 6.


8. Data Security

Society 3 operates its own membership and booking platform and takes reasonable and appropriate technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. These measures include encryption of personal information in transit and at rest, access controls limiting member records to authorized staff with an operational need, and restricted administrative access.

Payment card information is transmitted directly to Stripe, a PCI-DSS compliant payment processor. Society 3 does not store raw payment card data on its own systems.

Security camera footage is stored locally on studio equipment with restricted access and is retained for a limited period.

No system can be guaranteed absolutely secure. In the event of a data breach affecting personal information, Society 3 will provide notice to affected individuals as required by California Civil Code §1798.82.


9. Changes to This Privacy Notice

Society 3 reserves the right to update this Privacy Notice at any time. Material changes will be communicated to active members via email and/or the Society 3 app at least 14 days before taking effect. Continued use of our services following notice of a material change constitutes acceptance of the updated Privacy Notice.
