Billing

Your membership bills on your billing anniversary date each month - the same calendar date as your enrollment date. Your first charge is processed at time of purchase and covers your first full billing period. If your anniversary date does not exist in a given month, billing occurs on the last day of that month. Unused classes from one billing period carry over into the immediately following billing period only and expire at the end of that period.


Cancellation

You may cancel at any time by providing at least 30 days notice before your next billing anniversary date, using the same method by which you enrolled - online via the Society 3 app or website, or in person at the front desk - per California B&P §17602. Society 3 will confirm cancellation in writing within 3 business days.


Late Cancellation & No-Show

Class reservations must be cancelled at least 24 hours before class start time. Cancellations made inside this window or failure to attend without cancelling will result in a $22 fee charged to the payment method on file and forfeiture of the reserved class credit. Charged members are not eligible for a grace pass.


Founding Member Rate (If Applicable)

If this membership is purchased at the Founding Rate of $209/month, that rate is honored for as long as the membership remains continuously active with no lapse in billing exceeding 10 days. Voluntary cancellation permanently forfeits the Founding Rate. The Charged Founding Rate is capped at 50 memberships and is available only during the founding period.


Incorporation of Agreement Documents

By purchasing this membership, Member confirms they have read, understood, and executed the full Society 3 Agreement Documents, including the Membership Agreement, Liability Waiver & Informed Consent, Photo & Video Release, Studio Policies, and Privacy Notice (CCPA/CPRA). All terms contained therein are incorporated into this Purchase Agreement by reference and are fully binding.

Facility Opening Date - Presale Memberships (California Civil Code §1812.85(a))

The Society 3 facility at 21144 Ventura Blvd, Woodland Hills, CA 91364 will open and be available for use on August 1, 2026. If this agreement is signed before that date, no billing period begins and no membership services are owed until the facility opens. If the facility does not open within six (6) months of the date this agreement is signed, Member may cancel this agreement at any time and receive a full refund of all amounts paid.

Terms & Conditions

1. Auto-Billing & Charge Authorization

Membership dues are billed monthly on the Member's billing anniversary date - the same calendar date each month as the original enrollment date (e.g., a member who enrolls on the 15th is billed on the 15th of every subsequent month). If the anniversary date does not exist in a given month (e.g., the 31st in a 30-day month), billing will occur on the last day of that month. It is the member's responsibility to maintain a valid payment method. Failed payments may result in a brief service interruption and a $10 processing fee. Founding Member rates are honored for as long as the membership remains continuously active and in good standing with no lapse in billing.

Member authorizes Society 3 to charge the payment method on file for all applicable membership dues, late fees, no-show fees, freeze fees, retail purchases, and any other charges incurred under this agreement, without requiring additional authorization for each transaction.

2. Cancellation

Members may cancel their membership at any time by providing notice at least 30 days before the next billing anniversary date. Cancellations submitted less than 30 days before the next billing date will result in one final charge for the upcoming billing period, after which the membership will not renew.

In accordance with California Business & Professions Code §17602, members may cancel through the same method used to enroll - no cancellation method may be more burdensome than the original signup process:

  • Members who enrolled online or via the Society 3 app may cancel through the app or website.
  • Members who enrolled in person at the studio may cancel in person at the front desk.

Society 3 will send a written confirmation of cancellation to the Member's email address on file within 3 business days of receiving a valid cancellation request. Society 3 is not responsible for cancellations submitted through an unconfirmed or incorrect channel. If you do not receive a confirmation within 3 business days, contact Society 3 immediately at meow@society3studios.com.

2A. Statutory Cancellation Rights - Death, Disability & Relocation (California Civil Code §1812.89)

In addition to the cancellation rights above, and notwithstanding any other provision of this agreement:

  • Death or Disability. If the Member dies, or becomes disabled in a manner that affects the Member's ability to use or enjoy the studio's facilities, the Member (or the Member's estate or representative) may cancel this agreement at any time. Disability must be verified by a licensed physician. Upon such cancellation, no further payments are due, and Society 3 will refund a prorated portion of any amounts prepaid for the unused period, upon request.
  • Relocation. If the Member moves more than 25 miles from the Society 3 facility and is unable to transfer the membership to a comparable facility, the Member may cancel this agreement at any time. Upon such cancellation, no further payments are due, and Society 3 will refund a prorated portion of any amounts prepaid, less a cancellation fee of no more than $100 (or $50 if more than half of the membership billing period has elapsed).

These rights are provided by California law, cannot be waived, and take precedence over any conflicting term of this agreement, including the No Refunds provision in Section 4.

3. Freeze Policy

Members may request a membership freeze up to once per calendar year for a minimum of 30 days and a maximum of 60 days. A freeze request must be submitted in writing at least 7 days in advance. A $19.99/month freeze fee applies during any approved hold period. Founding Member pricing is preserved during an approved freeze, provided the freeze fee is paid. Membership may not be frozen retroactively.

4. No Refunds

Except as provided in Section 2A (statutory cancellation rights) and the Notice of Cancellation Rights below, all membership dues and class pack purchases are non-refundable. Partial month refunds or prorated credits will not be issued for dissatisfaction, scheduling conflicts, or non-use. Members are encouraged to use their freeze option if they need to pause participation.

Medical/Injury Exception: In the event of a serious medical condition or significant injury that prevents participation, Society 3 may, at its sole discretion, issue a prorated credit toward a future billing period. For purposes of this policy, a qualifying medical condition is one that, as documented by a licensed physician, prevents the member from participating in any physical fitness activity for a minimum of thirty (30) consecutive days. Minor injuries, general illness, or conditions that permit modified participation do not qualify. To be considered, the member must submit a written request along with documentation from a licensed healthcare provider (e.g., physician's note on official letterhead) within 14 days of the onset of the condition or injury. Approved credits will be applied to the member's account and may not be transferred or redeemed for cash. Society 3 reserves the right to approve or deny any such request and will apply consistent written criteria in evaluating all requests.

5. Late Cancellation & No-Show Policy

Cancellation windows and grace pass eligibility vary by membership tier as described in the Studio Policies. Late cancellations and no-shows are subject to a $22 fee per occurrence, automatically charged to the payment method on file pursuant to the charge authorization in Section 1.

Treatment by membership type:

  • Unlimited tiers (Committed, Complete, Black Cat): $22 fee per occurrence.
  • Class-allocation tiers (Core, Charged): $22 fee per occurrence, and the reserved class is deducted from the member's monthly allocation. The deduction reflects the member's use of the reservation itself: the spot was held for the member and made unavailable to others.
  • Class Pack holders: Forfeiture of the reserved session in lieu of a fee.
  • Single drop-in purchasers (TriMethod or Recovery Suite): Forfeiture of the drop-in payment in lieu of a fee, as stated in the applicable purchase agreement.
  • Recovery Suite sessions (Complete and Black Cat): $22 fee, and the session is forfeited from the member's monthly allotment.

Member expressly agrees that the $22 fee represents reasonable liquidated damages reflecting the genuine cost to Society 3 of an unfilled spot, including instructor time, reserved capacity, and operational overhead, and that neither the fee nor the deduction of a used reservation constitutes a penalty under California law.

6. Conduct

Members agree to abide by Society 3's Studio Policies at all times. Society 3 reserves the right to terminate any membership, with or without prior warning, without refund, in the event of misconduct, harassment, or repeated policy violations.

7. Rate Changes

Rates for the Core, Charged, Committed, Complete, and Black Cat memberships, as well as Class Pack and Recovery Suite drop-in pricing, are subject to change with a minimum of 30 days advance written notice delivered to the Member's email address on file. Founding Member rates are permanently exempt from any rate increases, provided the membership remains continuously active and in good standing with no lapse in billing. A lapse in billing that remains uncured for more than 10 days following written notice from Society 3, or any voluntary cancellation or account closure, will permanently forfeit the Founding Member rate lock. A failed payment that is corrected by the member within 10 days of receiving notice from Society 3 will not constitute a lapse for purposes of this rate lock provision.

8. Assumption of Risk, Waiver & Concurrent Execution

Member acknowledges that the Liability Waiver & Informed Consent is a required condition of participation at Society 3 and is incorporated into this Membership Agreement by reference. Society 3 requires execution of both documents prior to any participation. Member confirms that they have been provided with, have read in full, and are executing the Liability Waiver concurrently with this Membership Agreement. Member expressly acknowledges that the waiver of liability, release of claims, assumption of risk, indemnification obligations, and all other terms contained in the Liability Waiver are fully binding on Member to the same extent as if restated verbatim in this agreement. If Member has not been presented with the Liability Waiver at the time of signing this agreement, Member must notify Society 3 staff immediately and prior to any participation.

9. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to this agreement - including its breach, termination, enforcement, interpretation, or validity - shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in Los Angeles County, California, in accordance with AAA's Consumer Arbitration Rules then in effect (available at adr.org). This arbitration obligation applies equally to both the member and Society 3. Society 3 shall bear all AAA filing and administrative fees in excess of what the member would pay to file a comparable claim in small claims court. All arbitration shall be conducted on an individual basis only - neither party may bring a class, collective, or representative action. Each party expressly waives any right to a jury trial. The arbitrator's decision shall be final and binding on both parties.

Small Claims Option. Notwithstanding the foregoing, either party may instead pursue an individual claim in the small claims court of Los Angeles County, California, for any dispute within that court's jurisdiction. This preserves a low-cost forum for minor disputes without requiring arbitration.

Notwithstanding the foregoing, any claim seeking public injunctive relief under California law - including but not limited to claims under the Unfair Competition Law (B&P §17200) or the Consumer Legal Remedies Act - shall be heard by a court of competent jurisdiction and shall not be subject to arbitration, in accordance with McGill v. Citibank, N.A. (2017) 2 Cal.5th 945. All remaining claims shall proceed in arbitration as provided above. Nothing in this section limits either party from seeking emergency injunctive relief in court solely to prevent irreparable harm while arbitration is pending.

10. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any matter not resolved through arbitration under Section 9 shall be brought exclusively in a state or federal court of competent jurisdiction in Los Angeles County, California, and each party hereby consents to such jurisdiction and venue.

11. Entire Agreement

This Membership Agreement, together with the Society 3 Liability Waiver & Informed Consent, Photo & Video Release (if executed), Privacy Notice (CCPA/CPRA), and Studio Policies (collectively, the "Agreement Documents"), constitutes the entire agreement between Member and HIIT IT LLC regarding membership at Society 3. It supersedes all prior and contemporaneous discussions, representations, understandings, and agreements - whether oral or written. No employee, agent, coach, or representative of Society 3 has authority to modify, waive, or supplement any provision of the Agreement Documents except by a written amendment signed by an authorized officer of HIIT IT LLC. Member agrees that no verbal representation made at or after signup is binding on Society 3 unless reflected in a signed written amendment.

12. Severability

If any provision of this agreement is found to be invalid, void, or unenforceable under applicable California or federal law, that provision shall be deemed severed from the agreement. All remaining provisions shall continue in full force and effect and shall be construed to give maximum effect to the parties' original intent.

13. Force Majeure

Society 3 shall not be liable for any failure or delay in providing services resulting from circumstances beyond its reasonable control, including but not limited to: natural disasters, earthquakes, fire, flood, acts of government, public health emergencies, mandatory closure orders, building condemnation, or utility failures. In the event of a temporary mandatory closure of the Society 3 facility due to such circumstances, all affected members will be offered a complimentary membership freeze for the full duration of the closure. This emergency freeze will not count against the member's annual freeze allowance and will not incur the standard $19.99/month freeze fee. If Society 3 is unable to reopen within 90 days of the initial closure date, members shall be entitled to a prorated refund of any prepaid dues for the period during which services were unavailable, consistent with California Civil Code §1812.91.

14. Business Sale or Transfer

In the event of a sale, assignment, merger, or transfer of substantially all of Society 3's membership assets or business operations to a successor operator, Society 3 will provide all active members with at least 30 days written notice prior to the effective date of the transfer, delivered to the email address on file. All existing membership rights in effect at the time of transfer - including Founding Member rate locks, prepaid membership dues, and unused Class Pack sessions - shall be honored by any successor operator for the full remaining duration of each member's contracted term. If a successor operator declines to honor these existing rights, members shall be entitled to a prorated refund of any prepaid amounts covering the period following the transfer date. This obligation shall be disclosed to and acknowledged by any prospective purchaser or successor as a condition of the transfer.

Notice of Cancellation Rights - California Civil Code §1812.85

You, the buyer, may cancel this agreement at any time prior to midnight of the fifth business day of the health studio after the date of this agreement, excluding Sundays and holidays. To cancel this agreement, mail or deliver a signed and dated notice, or send a telegram which states that you, the buyer, are canceling this agreement, or words of similar effect. The notice shall be sent to Society 3 (HIIT IT LLC) at 21144 Ventura Blvd, Woodland Hills, CA 91364.

You may also cancel within this period through the same method used to enroll - online via the Society 3 app or website, or in person - in accordance with California Business & Professions Code §17602. Upon timely cancellation, all payments will be refunded within 10 days, less the value of any services already received. This statutory right cannot be waived or modified by any provision of this agreement.

Additionally, in the event Society 3 permanently ceases operations or relocates more than five (5) miles from 21144 Ventura Blvd, Woodland Hills, CA, members shall be entitled to a prorated refund of any prepaid membership dues for the unused portion of their current billing period, in accordance with California Civil Code §1812.91.

1. Nature of Activity

I understand that participation in group fitness classes at Society 3 involves vigorous physical activity including but not limited to: high-intensity interval training (HIIT), strength and resistance training, functional movement, kettlebell training, and cardiovascular exercise using machines and bodyweight. I acknowledge that these activities carry inherent risks including, but not limited to, muscular injury, joint strain, cardiovascular stress, cardiac events, falls, and equipment-related injury. I further acknowledge that Society 3 maintains an automated external defibrillator (AED) on premises in compliance with California Health & Safety Code §104113, and that all Society 3 coaches and staff are certified in CPR and AED use. I voluntarily assume the risk of cardiac and other medical events inherent to vigorous physical exercise.

2. Medical Clearance & Health Disclosure

I represent that I am in adequate physical condition to participate in group fitness activities. I acknowledge that Society 3 coaches are not licensed medical professionals, and nothing communicated by them constitutes medical advice, diagnosis, or treatment. If I have any pre-existing medical conditions, injuries, cardiovascular issues, orthopedic limitations, or other health concerns, I agree to consult a licensed physician before participating. I accept full personal responsibility for any medical decisions related to my participation. I agree to disclose any injuries or limitations to my coach before each class begins.

I understand that coaches provide general group instruction to the class as a whole and that it is my sole responsibility to self-regulate intensity, weight selection, range of motion, and overall effort based on my own physical condition and limitations at all times. No verbal cue, encouragement, or instruction from a coach constitutes a guarantee of safety or a representation that any specific movement or load is appropriate for my individual condition. I assume full and sole responsibility for all movement decisions I make during class, regardless of any verbal instruction received.

2A. Recovery Suite - Additional Assumption of Risk & Contraindication Acknowledgment

I understand that The Complete and Black Cat memberships, and the Recovery Suite drop-in, include access to the Society 3 Recovery Suite, which involves recovery modalities including pneumatic compression therapy (Normatec) and contrast (heat and cold) therapy (HypericeX), in addition to coach-led stretching and foam rolling.

I acknowledge that these modalities carry inherent risks separate from group fitness classes, including but not limited to: circulatory complications, dislodgement of blood clots, bruising, skin irritation, thermal burns, cold-related injury, dizziness, changes in blood pressure, and aggravation of pre-existing conditions.

Contraindication Acknowledgment. I represent that, to the best of my knowledge, I do not have any of the following conditions, and I understand that if I do, I must consult a licensed physician and obtain clearance before using the Recovery Suite:

  • Deep vein thrombosis (DVT), blood clots, or a history of clotting disorders
  • Peripheral arterial disease or other significant circulatory conditions
  • Pregnancy
  • Cardiovascular or heart conditions, including uncontrolled high blood pressure
  • Neuropathy or impaired sensation (including diabetic neuropathy)
  • Raynaud's disease or cold hypersensitivity
  • Open wounds, skin infections, recent surgery, or acute injury in a treatment area
  • Any condition for which compression therapy or heat/cold therapy has been medically advised against

I understand that Society 3 staff are not licensed medical professionals and cannot assess my individual suitability for these modalities. I agree to disclose any relevant condition before using the Recovery Suite, to follow all staff instructions regarding equipment use, and to discontinue use immediately and notify staff if I experience pain, numbness, dizziness, or discomfort during any recovery session. I voluntarily and knowingly assume all risks associated with my use of the Recovery Suite and its equipment, to the fullest extent permitted by California law.

3. Assumption of Risk

I voluntarily and knowingly assume all risks associated with participation in Society 3 classes and activities - whether on or off the premises - including risks arising from the active or passive negligence of Society 3, HIIT IT LLC, its owners, coaches, employees, agents, or volunteers, to the fullest extent permitted by California law. I further acknowledge and assume the inherent risk of potential exposure to communicable illnesses, including airborne and contact-transmitted infections, in a shared indoor fitness environment. I understand that Society 3 implements reasonable hygiene protocols but cannot guarantee a disease-free environment.

4. Release & Waiver of Liability

In consideration of being permitted to participate, I, on behalf of myself, my heirs, executors, personal representatives, and assigns, hereby release, waive, and forever discharge HIIT IT LLC, Society 3, its owners, coaches, employees, agents, successors, and assigns from any and all claims, demands, losses, causes of action, or liability of any kind - whether known or unknown, anticipated or unanticipated - arising out of or related to my participation, including claims arising from negligence.

Notwithstanding the foregoing, this release does not apply to claims arising from gross negligence or willful misconduct, which cannot be waived as a matter of California law. The inclusion of this limitation reflects the parties' shared intent to create a release that is enforceable to the maximum extent permitted by law.

5. Waiver of California Civil Code §1542

I expressly waive and relinquish all rights and benefits under California Civil Code §1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release." I acknowledge that I may later discover facts different from or in addition to those currently known, and I accept this waiver with full knowledge of this possibility.

6. Indemnification

I agree to indemnify, defend, and hold harmless HIIT IT LLC and Society 3 from any and all loss, liability, damage, cost, or expense incurred as a result of my participation in any Society 3 activity, including claims brought by third parties arising directly from my own conduct, actions, or negligence during participation. This indemnification obligation does not extend to claims arising from Society 3's own independent negligence or misconduct.

7. Emergency Medical Authorization

In the event of a medical emergency arising from my participation, I authorize Society 3 staff to contact emergency medical services on my behalf. I acknowledge that I am responsible for any costs associated with emergency medical care.

8. Severability

If any provision of this waiver is found to be invalid or unenforceable under California law, the remaining provisions shall remain in full force and effect.

9. Acknowledgment

I have read this waiver and release in its entirety. I understand its contents and I am signing freely and voluntarily, without inducement. I acknowledge this is a binding legal document.

Class Reservations & Cancellations

All classes must be reserved in advance through the Society 3 app or website. A reservation holds your spot - walk-ins are subject to availability and are not guaranteed.

Cancellation Windows by Membership Type:

  • Committed, Complete & Black Cat Members: May cancel up to 12 hours before class start time without penalty.
  • All Other Members (Core, Charged, Class Pack, Drop-In): Must cancel at least 24 hours before class start time to avoid penalty.

Grace Pass - Committed, Complete & Black Cat Members Only: Members on the Committed, Complete, or Black Cat membership tier are entitled to request one (1) grace pass per calendar month, which waives a single late cancellation or no-show fee. Grace passes do not apply automatically - members must contact the front desk by phone or in person to request the waiver before or within 24 hours of the applicable offense. Grace passes reset on the 1st of each month and do not roll over. Requests submitted outside the 24-hour window will not be honored. The second offense in a calendar month and any offense beyond are charged at the standard $22 rate regardless of membership tier.

Late Cancel & No-Show Fee: Cancellations made outside the applicable window, or failure to attend without canceling, will result in:

  • Unlimited members (Committed, Complete, Black Cat): a $22 fee charged to the payment method on file.
  • Class-allocation members (Core, Charged): a $22 fee, and the reserved class is deducted from the monthly allocation.
  • Class Pack holders: forfeiture of the reserved session (no fee).
  • Single drop-in purchasers (TriMethod or Recovery Suite): forfeiture of the drop-in payment (no additional fee).
  • Recovery Suite sessions: a $22 fee, and the session is forfeited from the monthly allotment.

Member acknowledges that these fees are intended to represent a reasonable estimate of Society 3's actual damages from an unfilled spot, including instructor time, reserved capacity, and operational overhead, and are not intended as a penalty.

Consistent no-shows or late cancellations (3 or more in a single month) may result in temporary suspension of reservation privileges at Society 3's discretion.

Booking Windows & Waitlists: Booking windows vary by membership tier:

  • Committed, Complete & Black Cat Members: May book up to 1 month (30 days) in advance for all classes.
  • All Other Members & Non-Members (Core, Charged, Class Pack, Drop-In): May book up to 2 weeks (14 days) in advance.
  • Recovery Suite Drop-Ins: May book up to 72 hours in advance only.

If a class is full, members may join the waitlist via the app. Waitlisted members will be auto-enrolled if a spot opens and will be subject to the same cancellation policy once enrolled. Members are solely responsible for removing themselves from the waitlist if they no longer intend to attend. Auto-enrollment from the waitlist does not exempt a member from the applicable late cancellation or no-show fee.

Arrival & Punctuality

All members are asked to arrive at least 15 minutes before class to allow time for check-in, warm-up, and equipment setup. This is especially important for first-time attendees.

If you arrive after class has started, you may be admitted only during a transition between rounds - not mid-round. This policy exists to protect the safety of all participants and maintain the integrity of the programming. Admission after start time is at the coach's discretion and is not guaranteed.

Society 3 is not responsible for missed class time due to late arrival. No refunds or session credits will be issued for late arrivals.

Phone Policy

We have a no-phone policy during class. Phones must be silenced and put away before class begins.

This policy exists for three reasons: focus, safety, and respect for your fellow members. Our programming is structured and moves quickly - distractions from phones can result in missed cues, improper form, and risk of injury. We want you fully present.

Members may use phones briefly before class starts or during designated breaks. Photography or filming of other members without their explicit consent is prohibited at all times.

Equipment & Space

  • Use all equipment only as directed by your coach. Improper or unsafe use may result in removal from class.
  • Return all equipment to its designated storage location after every class.
  • Do not remove equipment from the studio floor.
  • Members found to have damaged equipment through negligent or improper use may be assessed a damage fee not to exceed $500 per incident. This limitation applies to damage caused by ordinary negligence only. Society 3 reserves the right to seek full damages - without cap - for equipment damage caused by reckless conduct, intentional acts, or willful misconduct. Society 3 will provide written notice of the alleged damage within 5 business days of discovery, including photographic or written documentation. Members have 10 days from receipt of notice to respond in writing before any charge is applied to the payment method on file.

Hygiene & Studio Cleanliness

  • Sanitizer and towels are provided at the studio. Members are expected to wipe down all equipment and surfaces they use after class.
  • Wear appropriate, clean athletic shoes at all times on the studio floor. No bare feet during class.
  • Be mindful of fragrance - strong perfumes or colognes can be disruptive in a high-intensity shared environment.
  • Do not attend class if you are experiencing symptoms of illness (fever, active infection, vomiting, etc.). Society 3 reserves the right to ask any member exhibiting signs of illness to leave the premises.

Personal Belongings

Society 3 is not responsible for lost, stolen, or damaged personal belongings. Please store valuables securely. Leaving personal items unattended on the studio floor during class is at the member's own risk.

Guest Passes (Bring a Friend)

Members on an unlimited tier (Committed, Complete, or Black Cat) receive three (3) guest passes per calendar month, subject to the following terms:

  • TriMethod classes only. Guest passes may not be used for Sunday Recovery Suite sessions.
  • First-time guests only. Guest passes are valid exclusively for first-time visitors to Society 3. Individuals who have previously attended Society 3 in any capacity (as a guest, drop-in, class pack holder, or member) are not eligible for guest pass entry.
  • Waiver required. Every guest must create a Mindbody profile and complete the Society 3 Liability Waiver & Informed Consent before participating. No guest may take class without a signed waiver on file.
  • Subject to availability. Guests count toward class capacity and may only be booked into classes with open spots. A guest late cancellation or no-show forfeits the pass used.
  • Monthly reset. Guest passes reset on the 1st of each calendar month and do not roll over. Unused passes expire.
  • No cash value. Guest passes are non-transferable between members, have no cash value, and may not be sold or exchanged.
  • Revocable. Society 3 reserves the right to modify or revoke guest pass privileges at any time, including for misuse. The hosting member is responsible for their guest's conduct while in the studio.

Video Surveillance

Society 3 operates video security cameras on the premises for the safety of members, staff, and property. Please note:

  • Security cameras record video for safety, security, and incident documentation purposes only.
  • Security footage is never used for marketing, social media, or promotional content of any kind.
  • Cameras are located in training and common areas only. There are no cameras in restrooms.
  • Security cameras do not record audio.
  • Footage is retained for a limited period, stored locally on studio equipment with restricted access, and is not sold or shared with third parties except as required by law or in connection with an incident investigation or insurance claim.

Minors

Participants must be 16 years or older to attend Society 3 classes. If a participant is under 18 years of age, a parent or legal guardian must sign all Society 3 Agreement Documents on the participant's behalf prior to participation. A minor's signature alone is not valid or binding under California law. Minors may not sign any Society 3 document on their own behalf.

Health & Safety

  • Inform your coach of any injuries, limitations, or health conditions before each class begins. Coaches can offer modifications but are not licensed medical professionals.
  • If you feel dizzy, nauseous, or experience pain during class, stop immediately and notify your coach.
  • Nothing communicated by Society 3 coaches constitutes medical advice, diagnosis, or treatment.
  • Society 3 maintains a first aid kit and an automated external defibrillator (AED) on premises at all times, in compliance with California Health & Safety Code §104113. All coaches and staff are certified in CPR and AED operation. In the event of any medical emergency, staff will contact 911 immediately and administer emergency response as trained.

Disability Accommodations - ADA & California Unruh Civil Rights Act (Civil Code §51)

Society 3 is committed to providing reasonable accommodations to members and prospective members with disabilities in accordance with the Americans with Disabilities Act and the California Unruh Civil Rights Act. Society 3 does not discriminate against any person on the basis of disability, physical condition, or any other characteristic protected under California law.

Members who require an accommodation to participate in classes - including but not limited to modified movement sequences, equipment positioning, extended setup time, or other adjustments - are encouraged to notify a coach or staff member before class begins, or to submit a written request to meow@society3studios.com. Society 3 will evaluate all accommodation requests promptly and engage in a good-faith interactive process with the requesting member. Reasonable accommodations will be provided at no additional charge. Society 3 reserves the right to determine what constitutes a reasonable accommodation within the context of its group fitness programming and studio layout.

Member Conduct

  • Treat coaches, staff, and all members with respect at all times.
  • Harassment, discrimination, bullying, or intimidation of any kind will not be tolerated.
  • Society 3 reserves the right to refuse service or terminate any membership - immediately and without refund - for conduct harmful to the community, staff, or brand. The severity of the response will be proportionate to the incident.
  • Members removed for conduct violations forfeit any remaining prepaid sessions or membership term.

Agreement

By participating in Society 3 classes or maintaining an active membership, you agree to abide by all policies set forth in this document. These Studio Policies are part of the Agreement Documents and are incorporated into your Membership Agreement by reference.

Policy Updates: Society 3 reserves the right to modify these Studio Policies at any time. Members will be notified of any material change via the Society 3 app and/or the email address on file at least 14 days before the change takes effect. Continued use of Society 3 services on or after the effective date of any update constitutes the member's acceptance of the revised terms. If a member objects to a material policy change, they must notify Society 3 in writing within 14 days of receiving notice. A member who provides timely written objection may cancel their membership without incurring the standard 30-day advance notice obligation, provided the cancellation request is submitted within that same 14-day window. Society 3 will maintain a version history of all material policy updates, available to members upon written request.

This release applies only to marketing content intentionally created by Society 3 staff, such as class photos and short-form video shot for social media and brand channels. It does not apply to the studio's security camera system. Security footage is recorded for safety and security purposes only, is never used for marketing or promotional content of any kind, and is addressed separately in the Studio Policies and the Society 3 Privacy Notice.

By training with us, your likeness may be captured incidentally during staff-created content.

By signing this release, I grant HIIT IT LLC and Society 3 permission to use my name, image, likeness, and voice as captured in photographs and video recordings for promotional, marketing, and social media purposes across any media platforms - including but not limited to Instagram, TikTok, Facebook, and the Society 3 website - without monetary compensation.

I understand that:

  • I may withdraw consent at any time by submitting a written request to management.
  • Upon receiving a written revocation request, Society 3 will make commercially reasonable efforts to remove the member's likeness from Society 3-controlled channels - including its website and social media accounts - within 14 days. Society 3 does not guarantee removal of content that exists in archived formats, ad creative libraries, embedded website elements, or content that has already been reshared or reposted by third parties beyond Society 3's direct control.
  • Society 3 will not use my likeness in a manner that is defamatory, misleading, or harmful.
  • This release does not grant any right to use my likeness for commercial endorsement of third-party products without separate written consent.

Consent by Signature. I understand that signing this release is voluntary and is not a condition of membership or participation at Society 3. If I choose not to sign, Society 3 will make reasonable efforts to avoid featuring me in marketing content, though incidental background capture in a group fitness environment may still occur. By typing my name and submitting this release through the Society 3 / Mindbody system, I voluntarily grant consent to photo and video use as described above.
